This Acceptable Use Policy (“AUP”) sets out what is and is not permitted on the websites Gamma 91 builds, hosts, and maintains on your behalf. Violating these terms may result in suspension or termination of service. In any dispute over the interpretation of this AUP, our interpretation will govern, based on reasonable commercial judgment.
Gamma 91 is a fully managed service. We build and operate your site for you — so most obligations here concern the content and materials you ask us to publish, and your conduct as a customer, rather than the operation of any server.
Offensive content
You may not publish, or ask us to publish, any content through our services that we reasonably believe:
- Contains pornography, including child exploitation material;
- Incites or threatens violence, harassment, or hate speech;
- Is deceptive or unfair under consumer protection laws (for example, chain letters or pyramid schemes);
- Defames a person or invades an individual’s privacy;
- Poses a risk to public safety, compromises national security, or hinders a law enforcement investigation;
- Inappropriately discloses trade secrets or confidential information;
- Aims to circumvent copyright protections or infringe intellectual property rights;
- Promotes illegal substances, violates export laws, or pertains to illegal gambling or arms trafficking;
- Is otherwise unlawful, encourages illegal conduct, or is malicious, fraudulent, or likely to provoke retaliation against us.
Because we publish on your behalf, we may decline any request to publish material we believe falls into the categories above, and may remove such material from a live site.
Harassment & professional conduct
We maintain a zero-tolerance policy regarding harassment, malice, or abuse directed at our employees, representatives, or subsidiaries. Any form of harassment — including abusive language, cursing, threats, or expressions of hostility toward our staff or authorized agents — is strictly prohibited.
Our model depends on ongoing collaboration: you send us changes, and our team carries them out. Customers are expected to uphold professionalism in all interactions with our team, through any communication channel. If a customer violates this policy, we reserve the right to take corrective action, which may include suspension or termination of service. Such action may be taken with or without prior notice and without liability to the customer.
Your source materials
We recommend you retain your own copies of master source materials — such as original logo files and raw photography — as we do not warrant the preservation of source assets beyond what is required to operate your live website. Your rights to your website’s code and media after 36 months of service are governed by our Terms of Use.
Resource usage
Customers may not engage in activity that excessively consumes resources, disrupts performance, or negatively affects the stability of our platform. Any usage that leads to performance degradation or disproportionate consumption of shared resources is prohibited, and applies to all accounts. We reserve the sole right to define what constitutes resource abuse and to act to maintain service integrity. Accounts in violation may be suspended or terminated, with or without prior notice and without liability.
- Intended use.Your site is provided for your business’s own web presence. It may not be used for general file storage, media streaming, off-site archival, or as a content delivery or file-serving endpoint. Storage is for active website files and essential web content.
- Storage allowance. Media and file storage is subject to the limit stated for your plan. Most businesses use a small fraction of it; if you approach the limit, we will work with you to bring usage within it.
- Traffic. Visitor volumes are subject to the soft limit stated for your plan. We will contact you before taking any action on traffic grounds.
- Service allowances. Content Switches, Jobs, and page counts are subject to the monthly allowances stated for your plan. Requests beyond your allowance may be scheduled into a later month or quoted separately.
- Third-party integrations. Embeds and integrations we add at your request — payment links, storefronts, booking calendars, forms, and similar widgets — must not be used in a way that degrades site performance or violates this AUP.
Network abuse
Gamma 91 strictly prohibits all forms of network abuse, including denial-of-service attacks, phishing, port scans, and SYN floods. We reserve the right to determine what constitutes network abuse and to take appropriate action, with or without prior notification and without liability.
Customers may not engage in illegal, abusive, or irresponsible activity, including but not limited to:
- Unauthorized access to, or attempts to breach the security of, data, systems, or networks — including probing, scanning, or testing vulnerabilities without explicit authorization;
- Monitoring data or network traffic without the owner’s consent;
- Interfering with any user, host, or network service, including flooding or otherwise overloading a system;
- Unauthorized use of any internet account or computer, including credential theft;
- Engaging in conduct likely to trigger retaliation against our network;
- Using our network in a way that disrupts or unreasonably interferes with other customers.
Prohibited materials & services
Gamma 91 does not host materials or services including, but not limited to:
- Public proxies, torrents, Tor services, warez, escrow services, high-yield investment programs (HYIP), illegal gambling, and lottery sites or services;
- Distributed computing software, including coin miners of any kind;
- Any file-sharing, BitTorrent, or peer-to-peer network service, client, or server software.
Content “published or transmitted” through our services includes all web content, form submissions, and any other transmission that relies on our services.
Gamma 91 reserves the right to terminate service for any of the above reasons at its sole discretion, and to decide whether to issue a refund.
Security
As a managed service, we are responsible for the platform: hosting, SSL, software updates, and routine patching of the systems that run your site. You remain responsible for the following:
- Protecting any credentials issued to you, keeping them confidential, and changing them periodically;
- Not sharing account access with parties who are not authorized to act on your behalf;
- Keeping the primary contact details on your account current, so we can reach you about a security matter;
- Promptly notifying us if you suspect your account or site has been compromised;
- The lawfulness and integrity of any third-party service you ask us to integrate, and of any credentials or account you supply for it.
Gamma 91 makes no express or implied warranty regarding the security or functionality of third-party software, scripts, or services integrated at a customer’s request.
Material protected by copyright
You may not publish, distribute, or copy music, software, art, imagery, or any other work protected by copyright law unless:
- You have explicit authorization from the copyright owner; or
- You are permitted by United States copyright law to copy the work in that manner.
This applies to every asset you supply to us for publication — including logos, photography, written copy, fonts, and video. By sending us material to publish, you confirm you hold the rights necessary for us to publish it on your behalf. Gamma 91 reserves the right to terminate service for customers with repeated copyright infringements.

Your notice must include:
- A physical or electronic signature of a person authorized to act on behalf of the copyright owner;
- Identification of the copyrighted work claimed to be infringed, or a representative list if multiple works are covered by a single notification;
- Identification of the infringing material, with information reasonably sufficient for us to locate it;
- Your contact information, including address, phone number, and email address;
- A statement of good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law;
- A statement confirming the accuracy of the notice and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
Abuse reports
Our standard practice is to notify customers of AUP or Terms of Use violations; however, we reserve the right to suspend or terminate an account with or without notice. Customers must keep their primary contact details current. Violation details will be sent to the primary contact on file, with a timeframe in which to resolve the issue. We retain discretion over response times and further action if a matter is not addressed.
Examples of violations and the action we may take:
- Phishing. Offending material is disabled immediately, with a 24-hour window for the customer to respond. Failure to respond may lead to suspension of the affected site or the full account.
- Resource abuse. We provide a best-effort analysis and allow time to correct the issue. If it is unresolved, we may disable the offending integration or content, or suspend service, depending on severity.
- Prohibited content. Material falling under Offensive content or Prohibited materials & services may be removed from a live site immediately, with notice to follow.
These examples are general guidelines. Gamma 91 reserves the right to determine the appropriate action in each case.
Disclaimer
Gamma 91 is not obligated, and does not assume any responsibility, to monitor or oversee customer activity under this AUP. We disclaim all liability for misuse, unauthorized access, or violations occurring on our network by customers. While we reserve the right to investigate and respond to reported violations, responsibility for compliance with all applicable laws, regulations, and policies remains solely with the customer. We may, at our discretion, act when we become aware of misuse, but this does not constitute a duty to monitor or control customer conduct proactively.
